1. Acceptance of Terms

By downloading, installing, or using the Moot mobile application ("App"), developed by Studio42 ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

These Terms supplement and incorporate the Apple Media Services Terms and Conditions. If you are using the App on an iOS device, you agree to and acknowledge the standard Apple End User License Agreement (EULA).

2. Description of Service

Moot is an AI-powered decision-making application designed for entertainment purposes. The App presents a "Council" of AI agents—each embodying a distinct archetype—who engage in simulated debates to help users explore different perspectives on life decisions.

Users interact with AI characters including The General (Strategist), The Sage (Philosopher), The Skeptic (Risk Analyst), The Diplomat (Mediator), The Architect (Innovator), and The Inquisitor (Context Gatherer). These characters are fictional constructs powered by artificial intelligence.

3. Entertainment Disclaimer — Critical Notice

⚖️ MOOT IS FOR ENTERTAINMENT PURPOSES ONLY.

The "advice", debates, and suggestions provided by Moot's AI Council members are generated by artificial intelligence for entertainment and exploratory purposes. While we strive for thoughtful and engaging interactions, the AI may produce incorrect, biased, incomplete, or inappropriate content.

Moot does NOT provide:

  • Professional, medical, or health advice
  • Legal advice or legal opinions
  • Financial, investment, or tax advice
  • Mental health counseling or therapy
  • Emergency services or crisis intervention
  • Advice requiring professional licensure or certification

Any suggestions related to health, finance, legal matters, relationships, career decisions, or any other significant life choices are presented solely for entertainment and to stimulate thought. You must consult appropriate licensed professionals before making any decisions that could affect your health, safety, finances, legal standing, or wellbeing.

YOU ASSUME ALL RISKS ASSOCIATED WITH ANY DECISIONS YOU MAKE. THE COUNCIL'S "VERDICT" IS A FICTIONAL NARRATIVE DEVICE, NOT A RECOMMENDATION.

4. User Accounts & Eligibility

To use certain features of the App, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

You must be at least 13 years of age to use this App. If you are under 18, you represent that you have your parent or guardian's permission to use the App. Users under 18 should not share sensitive personal information in their Council sessions.

5. User-Generated Content

When you pose questions to the Council ("dilemmas") or interact with the Inquisitor, you are creating user-generated content. By submitting such content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store this content for the purpose of providing and improving the Service.

You agree not to submit:

  • Content that is illegal, harmful, or violates others' rights
  • Content intended to harm or deceive others
  • Sensitive personal information about third parties without consent
  • Content that could be used to facilitate illegal activities

We reserve the right to remove content that violates these terms and to suspend or terminate accounts that repeatedly violate our guidelines.

6. Subscriptions & In-App Purchases

Moot offers auto-renewable subscriptions ("Moot Pro") to grant access to premium features.

  • Payment will be charged to your Apple ID account at the confirmation of purchase.
  • Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase.
  • Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription, where applicable.
  • Prices are in USD and may vary by location. Price changes may occur with notice.

All purchases are final. Moot cannot issue refunds for purchases made through the Apple App Store; please contact Apple Support for refund requests.

7. Intellectual Property

The App, including its original content (excluding user-generated content), features, functionality, AI agent personalities, and character designs, is and will remain the exclusive property of Studio42 and its licensors.

The Council members (The General, The Sage, The Skeptic, The Diplomat, The Architect, The Inquisitor, The Adjudicator, and The Magistrate) are proprietary character designs. You may not copy, reproduce, or create derivative works based on these characters without explicit written permission.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOOT, STUDIO42, AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, data, or goodwill, whether incurred directly or indirectly
  • Any personal injury or harm arising from your reliance on the App's content
  • Any financial losses from decisions made after using the App
  • Any legal consequences arising from actions taken based on the App's content
  • Any damage to relationships, reputation, or career resulting from App use
  • Any content obtained from the App, including AI-generated "advice"

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND.

In no event shall our total liability to you for all claims exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Studio42 and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the App; (b) your violation of these Terms; (c) your violation of any third-party right; (d) any decision you make or action you take based on the App's content; or (e) your user-generated content.

10. Privacy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and share your information, including the content of your Council sessions.

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that you may assert claims in small claims court if your claims qualify.
